Agreement to Terms ("Agreement")

These Terms and Conditions of Use (the "Terms of Use") govern your access to and use of the productXpert™ website, located at https://www.productxpert.ai (the "Site"), and any associated services, applications, and tools provided by Ellwood Capital Invesents, LLC, DBA productXpert, its affiliates, and subsidiaries (collectively, "productXpert", "we", "us", or "our"). By accessing or using the Site, you agree to comply with and be bound by these Terms of Use. If you do not agree to these Terms of Use, please do not use the Site.


productXpert reserves the right, at its sole discretion, to modify, update, or amend these Terms of Use at any time. We recommend that you review these Terms periodically for any changes. Your continued use of the Site after the posting of changes constitutes your acceptance of those changes. As long as you comply with these Terms of Use, productXpert grants you a limited, non-exclusive, non-transferable, personal license to access and use the Site.

Use of Services

  • You must use our services only for lawful purposes
  • You agree not to misuse or attempt to disrupt our services
  • You are responsible for maintaining the confidentiality of your account
  • You agree not to misuse, abuse, or attempt to disrupt the service by interfering with or bypassing our security measures or service limitations

Search Quotas and Billing Cycles

For Free plan subscribers:

  • Your search quota is capped at 10 searches as a free trial
  • To obtain more searches, you must upgrade to the Xpert plan

For Xpert plan subscribers:

  • Your search quota resets to the plan's default amount at the start of each billing cycle
  • Unused searches from the previous billing cycle do not carry over
  • Additional searches purchased through the "Buy More Searches" feature are valid only for the current billing cycle
  • Any remaining additional searches will be lost when your billing cycle renews
  • Search quotas and purchased searches are non-refundable, except as required by law or in the case of a significant service failure
  • The reset occurs automatically, and no refunds are provided for unused searches
  • Your subscription will auto-renew at the end of each billing cycle unless you cancel it beforehand
  • Subscriptions must be canceled through our payment processor, Stripe

Data Sources and AI Technology

Our service utilizes OpenAI's technology to provide market insights and analysis. We respect your privacy and will only use your data in accordance with our Privacy Policy, which is available for review. You should be aware that:

  • Market insights and analysis are generated using AI technology
  • Data is processed through OpenAI's API
  • Results are algorithmic interpretations and should not be the sole basis for business decisions
  • We do not guarantee the accuracy or completeness of the AI-generated insights

Intellectual Property

All content, features, and functionality of our service are owned by productXpert and are protected by international copyright, trademark, and other intellectual property laws. This includes, but is not limited to, text, graphics, logos, images, videos, software, and other proprietary materials. Any use of the service and its contents outside the scope of these terms is prohibited without prior written consent from productXpert.


By accessing or using our service, you acknowledge and agree that all intellectual property rights associated with the content provided through productXpert are the exclusive property of productXpert or its licensors. You are granted a limited, non-exclusive, non-transferable, and revocable license to use the service for personal or business purposes as permitted by these Terms of Use.


If you submit any content, including but not limited to feedback, suggestions, images, videos, or text ("User Content") to productXpert, you grant us a worldwide, royalty-free, irrevocable, and sublicensable license to use, display, reproduce, modify, adapt, publish, translate, distribute, and otherwise exploit the content in connection with the operation of the service, including marketing and promotional materials. This license extends to all forms of media, now known or hereafter devised, and may be used for commercial or non-commercial purposes.


You represent and warrant that you have all necessary rights and permissions to submit your User Content and that your submission does not infringe upon the intellectual property rights of any third party. productXpert reserves the right, at its sole discretion, to remove or modify any User Content that violates these terms or is otherwise deemed inappropriate.


You retain ownership of any intellectual property rights in your User Content, but by submitting it to productXpert, you grant us the aforementioned license to use and distribute the content in accordance with these Terms of Use.


If you believe any content on the service infringes upon your intellectual property rights, please contact us with the necessary details to address your concerns.

Limitation of Liability

productXpert shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the service. We are not liable for any damages arising from third-party content, services, or actions that may be accessed through our platform.

Disclaimers

  • Our service is provided "as is" without any warranties
  • We do not guarantee the accuracy of market analysis or predictions
  • Business decisions based on our insights are made at your own risk
  • You are solely responsible for securing any data you input into the service. We are not liable for any loss of data, disruptions, or inaccuracies caused by third parties

Search History Retention and Deletion

By using productXpert's services, you acknowledge and agree that we may collect and store your search history as part of your user experience. However, productXpert retains the right to delete any search history records older than 90 days. After this period, your search history will be permanently erased from our systems, and we will no longer be able to retrieve or provide access to this data.

Marketing Communications Consent

By signing up for an account with us, you agree to receive marketing communications, including promotional emails, updates, and offers related to our products/services. You may opt-out of receiving these communications at any time by following the unsubscribe instructions included in each email or by adjusting your communication preferences in your account settings.

Changes to Terms

We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify you of material changes to these Terms of Use via email or a prominent notice on the site. Your continued use of the service after any such changes constitutes acceptance of the new terms.
